Qualified Domestic Relations Orders (QDROs)
A QDRO is a court order that requires a retirement plan that is not exempt from the provisions of the Employee Retirement Income Security Act (ERISA) to assign a portion of a participant’s plan benefit to a spouse, former spouse, child, or other dependent for purposes of marital property rights, alimony, or child support. A DRO is such a court order for a non-qualified plan, like a governmental plan. Without a DRO or QDRO, a retirement plan could neither be invaded without penalty to the participant nor assigned to anyone else.
Retirement Plan Valuations
Pensions are defined benefit plans. They promise employees periodic payments at the end of their working careers. A pension valuation determines the present value of an employee’s expected benefit after retirement. The resulting computation is the amount of money that needs to be invested at the assumed “discount rate” to fund the benefit stream over the pensioner’s assumed lifetime.
